1. Agreement
These Terms are an agreement between the person or organization using FunnelLingo (“Customer,” “you”) and Moosh Works LLC, the owner and operator of FunnelLingo (“we,” “us”). By installing, accessing, or using FunnelLingo, you agree to these Terms and the Privacy Policy. If you use the service for an organization, you represent that you can bind it.
2. The service
FunnelLingo helps discover, translate, review, and display static authored copy on published websites and funnels. Multilingual SEO is included. Search indexing is currently disabled; activation follows project verification and approval. Search rankings are never guaranteed. Hosted translated pages, reviewed metadata, language annotations, and multilingual sitemap publication form the SEO delivery path. The language switcher can also translate authored copy on the original page.
Some features may be marked preview. Those features may change and may have limits or defects.
3. Accounts and authority
- You must be at least 18 and use the service for lawful business purposes.
- You must have authority to connect the account, select the pages, process the content, and publish the translations.
- You are responsible for authorized users, account configuration, protected terms, domains, and published content.
- You must keep account credentials and connected-platform access secure and promptly report suspected misuse.
4. Customer content
You retain your rights in source copy, context, glossary terms, translations, and brand material. You grant us a limited license to host, copy, process, transmit, and display that content only to provide, secure, support, and improve the service.
You represent that you have the rights and permissions needed for the content and its translation. Do not submit personal, confidential, regulated, infringing, deceptive, malicious, or unlawful content.
5. Machine translation and publication
Machine-generated text is probabilistic and can be wrong. Automated guards reduce some structural errors but cannot confirm factual, legal, medical, financial, cultural, or linguistic accuracy. You are responsible for reviewing source and translated claims, prices, guarantees, disclosures, calls to action, and regulated content before publication.
Human-approved translations remain locked from automated replacement until an authorized reviewer reopens them. Source or context changes may return affected translations to review.
6. Acceptable use
You may not:
- submit passwords, authentication material, payment-card data, government identifiers, health data, or visitor-submitted form values;
- use the service for unlawful, infringing, deceptive, discriminatory, abusive, or malicious content;
- upload malware, executable code, or prompt attacks intended to affect another customer or the service;
- probe, bypass, disable, or evade tenant boundaries, rate limits, ownership checks, security controls, or usage limits;
- access another customer’s workspace or resell the service outside permitted plan or marketplace terms; or
- misrepresent machine output as certified or professionally reviewed when it is not.
7. Privacy and security
Our data practices are described in the Privacy Policy, Subprocessor List, and Data Processing Addendum. You are responsible for the privacy notices, legal bases, consent, and instructions required for your websites, markets, users, and content.
8. Availability and changes
We aim to keep the service available, but do not promise uninterrupted or error-free operation. Connected platforms, hosting, model providers, customer pages, browsers, and networks may fail or change. The language switcher is designed to leave the original page usable when FunnelLingo is unavailable.
We may change, suspend, or discontinue features to address security, law, provider changes, misuse, or product needs. We will give reasonable notice of material changes when practical.
9. Fees
FunnelLingo is sold through the connected app marketplace. The price, trial, renewal, taxes, usage terms, and other purchase details shown before checkout control. Review the selected plan for its price, trial, target-language allowance, managed translation words, connected language hostnames, and active published translated URLs. These allowances are shared across projects in the installed business account. Reseller markups and applicable taxes may change the checkout total.
One source word translated successfully into one target language uses one managed translation word. Cached reuse, unchanged matches, human edits, failed attempts, duplicate retries, and externally supplied translations do not consume that allowance. The current translation allowance resets at the start of each UTC calendar month, without rollover. One separate translation allowance covers the full trial, even when it crosses a month boundary. Subscription charges retain their own billing dates. Agency translation allowances are shared across covered client locations. Each active published page in each language uses one URL slot, including pages excluded from indexing. Reaching a limit does not authorize extra charges. Extra usage is off by default and requires explicit consent to the selected plan’s per-word rate and a monthly spending cap. Displayed 10,000-word or 100,000-word amounts are rate comparisons, not minimum purchase blocks. Only successful excess words are charged. Accepted jobs reserve a maximum charge and may finish within that authorization after extra usage is disabled. Trials do not allow paid overages. The monthly cap covers FunnelLingo usage charges; applicable taxes and reseller charges may differ.
Use the marketplace subscription controls or contact support to ask about cancellation or billing. Refund eligibility follows the purchase terms and applicable law. While the subscription remains entitled, a translation or capacity limit pauses new consumption and preserves existing published pages and editing or republishing within capacity. Subscription expiry and security revocation follow their separate policies.
10. Third-party services
FunnelLingo depends on a customer-selected CRM platform, Cloudflare, OpenAI, and other providers listed on the Subprocessor List. Their services and terms are separate. We are not responsible for third-party outages, platform changes, or content outside our reasonable control.
11. Our property
We and our licensors retain rights in FunnelLingo’s software, interfaces, documentation, brand, and service design. These Terms do not grant rights to our marks or any connected platform’s marks. Feedback may be used without restriction or payment, but we will not identify you publicly without permission.
12. Suspension and termination
You may stop using the service and disconnect it at any time. We may limit or suspend access for security risk, unlawful use, material breach, nonpayment, excessive load, or a connected-platform requirement. Where practical, we will give notice and a chance to fix the issue.
After disconnect or uninstall, access stops and the 30-day cleanup process described in the Privacy Policy applies. Terms that by nature should survive—including ownership, disclaimers, liability, and governing law—remain in effect.
13. Disclaimers
To the extent permitted by law, FunnelLingo is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted availability. We do not warrant translation accuracy, conversion results, search visibility, regulatory compliance, or compatibility with every page or third-party component.
14. Limitation of liability
To the extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity. Our total liability arising from the service will not exceed the greater of the amount you paid for FunnelLingo during the 12 months before the event or US $100.
These limits do not apply where law prohibits them and do not limit liability for fraud, willful misconduct, or obligations that cannot legally be limited.
15. Governing law and disputes
These Terms are governed by Tennessee law, without regard to conflict-of-law rules. Courts located in Hamilton County, Tennessee will have exclusive jurisdiction, except where applicable law gives you a different right. Before filing a claim, each party will try in good faith for 30 days to resolve it through the support contact below.
16. General terms
If a provision is unenforceable, the rest remains effective and the provision will be enforced to the lawful extent. A failure to enforce a term is not a waiver. You may not assign these Terms without our consent, except with a merger or sale of substantially all assets. We may assign them as part of a reorganization, financing, merger, or sale. These Terms and linked policies are the agreement about the service unless a signed agreement says otherwise.
